Lubeck, one of Bundy’s lawyers, filed the motion in Third District Court on grounds Bundy - was originally identified in an improper police lineup. ° Bundy, 29, a University of Utah law student from Tacoma, Wash., is charged with kidnaping the girl from a Murray mall in November of 1974. Charges of attempted murder in the case were dropped. The motion to suppress will be heard by Third District Judge Stewart M. Hanson Jr. Bundy is scheduled to stand trial on the kidnap ’ charge Feb. 9 in district court. The motion says pretrial confrontations be- tween Bundy and Miss Carol Da Ronch “were conducted in such “an impermissibly suggestive manner as to give rise to a very substantial likelihood of irreparable misidentification.” The girl identified Bundy ina police jineup Oct. 2, 975.
