where the above referred to hearings took place, sitting at
the defense cOunsel table throughout both days hearing sessions.
The "Chicago Tribune”, a local Chicago daily news paper,
edition of November 20, 1970, contained an article relative to
Hoffmin's attendance at the hearing se;sion on November 19,
1970. The article noted he was the orly one of the five convicted
defendants who was in Chicago for the hearing. It also noted
that a he®ring had been held that date in Municipal Court,
Chicago, before Judge Kenneth Wendt, at which Judge Wendt had
refusec & motion made by & local attorney o1 Hoffman's behal?,
calling for a new trial on a conviction for resisting arrest
during the Democratic National Convention in Chicago in August,
19GE. Judge Wendt had then set December 3, 1970, for Hoffman
to surreider and begin serving a fifteen day jail sentence
imposed efrlier on that conviction. 1G
On November 27, 1970, Deputy U.S, Marshal
advised he was in receipt of a letter from Hoff{mar, the letter
gated Noverber 23, 1970, Hofinnn had advised therein that
he would trevel via @ir to Chicago on DJecember 2, 1979, and on
December 3S, 1570, would begin serving . jail senter.ce at Cook
County Jail. Chicago, until December 17, 1970. On December 17,
1970, upor. his release from Cook Count. Jail, he would return to
New York City.
On December 1, 1970, Robert 3erenec, Cook County
States Attorney's Office, 26th and Ca’ifornia, Chicago, advised
that Hoffran had been originally convicted by dudge Wendt, in
a bench trial on January 28, 1969, in ‘ass Arrest Court, Chicago,
He was sentenced to one years probatio. on the charcze of resisting
arrest August 28, 1968, with the first fifteen days to be
served in Cook Courty Jail.
He advised that this conviction had been upheld
March 24, 1970 by the Illinois Supreme Court. The conviction
was then appealed to the U.S. Supreme Court, which o: November
9, 1970 denied Noffman a hearing on th» conviction. On
November 19, 1970, in Judge Wendt's co.irt, counsel for Hoffman
had moved for a new trial, however, thit motion was denied by
the court and the case was then contimied to December 3, 1970,
at which time Hoffman was ordered to appear to commence serving
the fifteen day sentence imposed.
