On February 14, 1970, near the end of the
abov@ trial, HOFFMAN was cited by trial Judge JULIUS J.
pene for criminal contempt of court on 23 separate
coun as a result of his actions and statements in
court during that trial. He was sentenced to a total of t |
eight months in the custody of the Attorney General, bond
was denied and on February 14, 1970, he was incarcerated z
in Cook County Jail, Chicago,
On February 28, 1970, the USCA, Chicago, issued
an order for the release of HOFFMAN on bond, set in the
amount of $25,000,
On May 11, 1972, the USCA reversed the conterpt
convictions of HOFFMAN and remanded them to the USDC, Chica;o,
for a new trail before a judge other than the orivinnl trial
judge,
On November 1, 1972, Assistant United States
Attorney (AUSA) GARY STARKMAN, Northern District of Illinois
(NDI), Chicago, advised that on October 30, 1972, United
States Supreme Court Chief Justice YARREN BURGER had
announced the appointment of USDC Judge f£UWAR}) T. GIGNOUX,
Portland, Maine, to rchcar the contempt convictions of
HOFFMAN, and his fellow defendants from the Conspiracy
Seven trial, likewise cited for contempt by Judge HOFFMAN,
On November 29, 1972, AUSA STARMAN advised the
Government had determined that in the retrlal jo ects:

contempt citations would be dropped, with only seven to be
prosecuted,
On October 29, 1973, trial of HOFFMAN and his
associates comnuenced in USDC, Chicago, on the contempt
charges. On Novenber 3, 1973, after defense arguments for
directed verdicts of acquittal on all counts, Judge GIGNOUX
dismissed two of the seven remainins counts arainst HOFFMAN.
On December 4, 1973, at the conclusion of the
bench trial, Judge GIGNOUX acgquittcd NOF}YMAN on three of
the five cuntempt counts and odjudged him puilty on the
remaining two, He set December 6, 1973 for sentencing.
On December G, 1973, Judge GIGNOUX discharged anu
released HOFF'AN, statin; that in the present circunstances
surrounding this retrial, he felt the guilty finding was
sufficient punighment and that some four years after the
original trial, no warrant existed for imposition of a jail
sentence on HOFFMAN beyond the time already served by him
(February 14, 1970 - “ebruary 28, 1970),
