Justice Fortas called me at approximately 4:10 p.a.
today. He stated he was ashamed to bring this matter up;
however, several “friends” (obviously meaning President
Johnson) had instructed him to call the FBI and bring this
matter to our attention,
He then explained that on the occasion of his
first confirmation as a Supreme Ceurt Justice he was waylaid
upon entering the hearing room by a member of the American
Nazi Party, who gave forth with abusive language. The "Nazi"
attempted to delay the Justice from entering the hearing
Toom,
The Justice stated he was not asking for any favors,
but he did want to let the FBI know that he will probably be
called before the Senate Judiciary Committee at 10 a.m., on
Thursday, 7/11/68. He indicated he would go first to the
office of Senator Albert Gore (D. -— Tennessee), inasmuch as
Gore represents his home state. Gore will then accompany hin
to the Senate Judiciary Committee "REE Ye 256 lia G /
Justice Fortas told me that a “nose count” reveals
that approximately 65 members of the Senate are in favor of
his confirmation as Chief Justice. He stated that some of the
dissenters actually do not realize the strong stand he has
taken on several occasions to defend law enforcement. He added
that the public is not aware of the fact that the Supreme Court,
during the time he has been on the court, has tunsed=-dewnx
of the 1800 criminal cases appealed to the court.
