Airtel to SAC, New Orleans Re: Adler Berriman Seal; et al; Narcotics The AOC has mandated that all Form 1 and Form 2 submissions beginning with new Title III court orders on or after 1/1/80 be submitted on the forms attached. AOC is authorized to issue binding regulations dealing with the content and form of the reports required to be filed under subsection (1) and (2) of Title 18, U.S.C., Section 2519. The following procedural steps are to be followed in order to comply with the current instructions of the AOC, the Department of Justice, and the FBI: Step 1 - FBIHQ ELSUR Index, upon becoming aware of a new Title III court order being signed, will, on a case-by-case basis, forward by airtel under the substantive case caption to the field office involved a prenumbered, precarboned Form 1 and Form 2 packet as provided by the AOC. Step 2 - By return airtel under the substantive case title, the field office involved is to advise FBIHQ of the name of the prose- cuting official making the Title III application and the name of the Special Agent who will then have the responsibility for completing the’ enclosed packet. This airtel should be submitted inside a sealed brown envelope clearly labeled "Director, FBI, ELSUR Index, FBIHQ.” Step 3 - Form 1 reports are to be submitted on or before the 30th day following the denial of a court order, or, in the case of the issuance of such an order, on or before the 30th day following the expiration of the order, including all extensions. The desig- nated Special Agent and the prosecuting official will complete the Form 1 portion of the enclosed packet. Step 4 - The prosecuting official shall then be responsible for providing the issuing Judge the Form 1 for his review, approval, and signature in order for the Court to forward the Form 1 to the AOC in compliance with Title 18, U.S.C., Section 2519 (1). Step 5 - The FBI has assumed the responsibility for the submission of the Form 2 (ply 3 of the enclosed packet) to the AOC in place of the prosecuting official as is indicated on the enclosed material.
