The Inquest Rules
Kennedy Wants
BOsTON-Senator Edward M. Ken-
nedy has asked the Supreme Judicial
Court, of Massachusetts to set ground
rules for any inquest into thedeath of
Mary Jo Kopechne.
Specifically, an attorney representing
Mr. Kennedy requested:
. That the press and public be barred
from the proceedings.
. That Judge James A, Boyle of the
qualified from presiding.
That Senator Kennedy be-permitted

powered to cross-examine witnesses and
object to evidence.
These requests were presented in a
two-hour hearing October 8 before five
) justices of the Massachusetts court. An

The inquest was postponed to Iet the
State's highest court hear the appeal by
'Senator Kennedy.
. Attorneys for Mr. Kennedy and nine
other potential witnesses at the inquest
argued that their clients' constitutional
rights would be seriously compromised
under rules set by Judge Boyle.
Senator Kennedy, his. counsel said,
cusatory proceeding which could result
in criminal action.
Joseph J. Hurley, an assistant attorney
general who represented Judge Boyle,
said an inquest could clear persons of
suspicion. He added:
"Kennedy himself, on television, re-
ferred to innuendo and' whispers and
gossip. An inquest could serve 'to end
this and to protect and clear the good
name of Miss Kopechne as well."
