You asked for comments on the attached paper (Tab A} which was, I understand, prepared by an unidentified author in the Depart- ment of State for consideration by Governor Herter. 1 have restricted consideration of it to the Chief of the PP Staff and myself and offer the attached analysis (Tab B) for your personal consideration as an internal CLA document and not as a preposed reply to Mr. Herter. It will be clear to you that we have taken the werding of NSC $412/2 absolutely literally. This, inevitably, raises an iesue in almost black and white terms. For our guidance, I would like yeur decision as to whether the comments iz Tab B fit your interpretation of the charter fer covert operations and whether they censtitute, in general, @ position that you believe shauld be maintained. 1 gealize, of course, that adherence to this position peed act iavelve such a blunt statement of the ieques but I would appreciate your apecifie ruling an the matter at this time in order te guide our handling of the various lisisen re- lations invelved.
