Re: Request to Preserve Evidence
Sr . This follows up the September 19th FBI letter from our New York Office ©
directing you, pursuant to Section 2703(f) of Title 18, United States Code, to preserve records
and materials pertaining to Adrian Lamo. After consultation with our New York Office, we
have determined that Section 2703(f) does not apply to you under the circumstances presented in
this case. We regret this misunderstanding and any inconvenience that it may have caused you.
We ask, however, that you voluntarily take appropriate action to preserve relevant
records and materials. Notwithstanding the incorrect reliance on Section 2703(f), the New York
letter was an earnest effort to alert you that any materials pertaining to Adrian Lamo in your
possession might be of evidentiary value. Since Mr. Lamo allegedly targeted several computer
networks belonging to the news media during the course of his illegal activities, records and
materials probative of this activity may be of significant assistance in bringing
Mr. Lame to justice. Mr. Lamo's victims, including members of the media, share with the-FBI a
common interest in ensuring that no investigative avenue is foreclosed by the inadvertent
destruction or loss of relevant materials.
Hence, we seek your continued cooperation in our investigative-effort. FBI
personnel will be in further communication with you to determine whether we can reach a mutual
agreement on how best to serve the respective professional obligations of you and the FBI while
advancing the investigation, In the interim, again, we regret any inconvenience that the original:
