The Atlanta Office of the PBI, in conjunction with,
the U. S. Attorney's Office and the Attorney General's Office
for the State of Georgia, are pursuing installation of a beeper |< -
tracking system on the suspect Williams’ car and installation
of a microphone in the suspect's car. Provisions of the State
of Georgia Code Annotated provide for electronic surveillance
under Section 26-3001, Et Seq, for peace officers to install
and monitor electronic surveillances with the FBI being °
considered as peace officers under the definition, Section
26-401, and specific exception for law enforcement under
Section 26-2004 of the State of Georgia Code Annotated,
On May 27, 198%, an affidavit was being drafted by —
both the U. S. Attorney's Office, Atlanta, Georgia, and the
Attorney General's Office, State of Georgia, for authorization
to place the automobile beeper tracking system on suspect
Williams' car. In anticipation of the imminent drafting of an
affidavit for a State of Georgia electronic surveillance, a
microphone in suspect Williams' car, a request has been made by
the State of Georgia through the Attorney General's Office for
the FBI to participate in monitoring this surveiliance and to” ~~
install the microphone. U. S. Department of Justice Order
#890-80, dated April 29, 1980, entitled “Delegation to the
Assistant Attorney General, Criminal Division, of the Authority
to Lend Electronic Surveillance Equipment," specifically states
in Section (g), “No FBI personnel may be used to install the
equipment or participate in the surveillance. This does not
prohibit maintenance and repair of the equipment when not
installed.”
Due to the sensitivity both of the investigation and
the suspect developed, as well as the sophisticated nature and
complexity of the contemplated microphone equipment to be used,
it is specifically requested that for this instance an ..
exception be made to Departmental Order #890-80, Section (g),°
to allow the FBI to participate to the maximum extent possible
with State authorities in both the installation and monitoring
of this State of Georgia electronic surveillance. The nature
of tnis equipment is such that an experienced individual is |
required to insure adequate installation and efficient
functioning. The PBI possesses both the equipment and
expertise needed.
