4 TOlwell Mr. Mallen Mr. Steel Mr. Monroe Mr. Mintz 2 Mr. Assistant Attorney General June 8, 1 Criminal Division 1 - Mr. Bayse birector, PBI é faten: ote - Mr. Castonguay 1 - Mr. Gilbert b9C LOAN OF ELECTRONIC SURVDILLANCE pQUIPHMENT = Mr. Reference is made to memorandum dated May 27, .1981, to the Attorney General, concerning the murders and/or disappearance of black residents of the City of Atlanta, Georgia, since July 20, 1979. Enclosed is a letter from Arthur K. Bolton, Attorney General of the State of Georgia, concerning the required certification relating to the FBI's loan of electronic surveillance equipment to the Atlanta Police Department (APD). By Departmental Order #890-89, the Attorney General estab- lished the required guidelines and procedures for tha F3I to loan electronic surveillance equipment to state and local law enforcement agencies. This order specifies that the FBI provide the required written certification from the state or local agency to the Assiscant Attorney General, Criminal Division, United States Duepartmant of Justice (DOJ), within five working days of the loan. Referenced memorandum dated May 27, 1961, which was a»proved by the attorney General on that date set forth, in part, “Due to tha sensitivity both of the investigation and the suspect devcloped, as well as the sophisticated nature and complexity of the contemplated microphone equipment to be used, it is specifically requested that for this instance an exception be made to Departmental Order #299-60, Section (g), to allow the Fal to participate to the maximum extent possible with state authorities in both the installation and monitor- ing of this equipment is such that an experienced individual ie _ required to insure adequate installation and efficient functioning. The FBI possesses both the equipment and expertise needed." Enclosure NOTE: The enclosure to this memorandum is submitted pursuant to Memorandum dated 5/16/80 from the Assistant Attorney General, Philip B.
