Honorable William J. Baxley NOTE: Captioned case concerns bombing of 16th Street Baptist Church in Birmingham, Alabama, 9/15/63, resulting in four deaths and personal injury to 16 other persons. At his request, after appropriate contact with Civil Rights Division, we furnished certain results of our in- vestigation to Baxley. By airtel 7/9/76, Birminoghan listed numerous docuncnts furnished to Baxley and advised that no additional information had been requested by hin since 3/5/76, the date on which the last docuncnts requested wero furnished. Apparently based on reeults of his review of documents previously furnished, Baxley has requested to interview 23 Special Agents who participated in above investigation in Birmingham in 1963-64. Our initial Fesponse advised we would authorize submission of written questions to the Agents as a means of cooperation but maintaining integrity of our files and pending matters within Birmingham Division. Incoming advised that approach unsatisfactory. It algo alleges Bureau has not been responding satisfactorilyto Baxley's past requests (for facts gece memorandum 3/30/76, copy attached for ready reference) and that Birmingham hes not answered telephone calls from Baxley's staff. Aspect regarding suggestion of Birmingham for presence of Legal Counsel Division representative at iLaterviews coordinated with that Division.
