W. R. Foster, being duly Bworny on oath deposes and says:

That he ig a polioe officer of Hialeah, Florida, and have
been such for the past turee yeara;
That on January 17, 1929, he was assigned to the horse
races at Hialeah, Florida, and did continuous duty from that
date until February 1, 1929 at the race track, to wit, the
race track of the hiani Jockey Club, Hialeah, Fla.; :
That he saw AL Capone at least every other day at the
Hialeah Race track herein mentioned fron January 17, 1929 up
to and inoluding February 1, 1929;
That on February 15, 1929 he did continous duty until the
day of the ckosing-of-the race track, March 13, 1929 - working
at the pace track as a police officer there; that he, a?fiant,
sav said Al Capone at least every uther day at the track between
February 15 and March Sth, or in other words, between February
15, 1929 and the period ending about eight gays before the race
track closed.
