I have tne honor to enclose copy of an affidavit pre-
sented to Jadge Wilxerson of this district, on March 12, 1929,
wherein it {s alleged by one Doctor Kenneth Phillips toat Al
Capone was confined to his bed op account of illness for a pe-
riod of six weeks subsequent _to Janiary 13,1429,
in Miami Beach, Florida.
Tt 18 the opinion of this office that this affidavit
is false. If it can de proved to be false it seems to me chat
doth the toctor, who executed the affidavit, and Al Capone, sho
was instrumental in naving it presented to Judge Wilkerson for
the purpose of obtaining # continuauce of his response to a
grand jury subpoena, can ve punisned for contempt of court.
Mr. A. P. Madden of the Iatelligence Unit here at Chicago was
