Qy/ohnson, Chicago,T11inois | recently, the latter recited that he had int 4 ad certain persons in’? ?-, Florida regarding the case entitled ALPHONSE CAPONE, Contempt of Court, as who were never contacted by Special Agents of the Bureau of Investigation. Please be advised that I have obtained through Special Assistent to the Attorney Genera] William Froelich, a complete list of the witnesses who were subpoenaed in the above entitled case and ghecked same with the file in this office, with the result that all they tnesses who were sub- poensed had previously been interviewed by Special agents of the Bureau of Investifation. It appears however, that two witnesses, namely Charles glatrke, Special 4pent,Bureau of Internal Revenue, Jacksonville, Florida, and ~ RaymondgZrown, attorney for the Bureau of Internal Revenue, Jecksonville, Florida,appeared voluntarily end testified. The names of these two individuals do not eppear in the Bureau file. Mr.Froelich informs me that Mr.Brom testified that he had seen subject in Florida on one occasion, and that Charles Clarke likewise testified that he is acquainted with subject Cepone, and saw him in Flori- da on one occasion. Mr.Froelich recites that the testimony of both of these individuals was immaterial and irrelevant. I have been endeavoring to obtain a transcript of the testimony of these two witnesses, but due to the present trial of subject Capone, on @ charge of failure to make proper income tex returns, Kr.Froelich has been uneble to obtain the desired data. 649 ne ed ak Se. pe
