Dear Sir:
With reference to the above captigned case, please be
advised that inquiry at the office of the Clerk ef the U. S.
Circuit Court of Appeals reveals that no decision on the appeal
of Subject Capone on the sentence imposed by U. S. District Judge
#ilkerson on March 2, 19231, has been given.
February 26th being the last dey of the January session
of this court, it would appear fram the statement of K. J. Carrick,
Assistant Clerk, that the chances for a decision on this case
within the next thirty days are very good. He stated that the
new tern begins on the second Tuesday in April 1932 and that the
prosnects are eood for disposition of all eases now on the docket
before that time.
