DECI e'73I Pr MEMORANDUM FOR THE DIRECTOR. 64-180 On the 15th. instant Special Agent in Charge McSwain called on the telephone and apvised that a conference was then in progress in the Bureau of Investigation between Assistant United States Attorneys and the Warden of the jail at Chicago relative to the reported privileges granted to 42Capone; that: the office of the United States Attorney, after considering the facts in the case had decided that if the allegation proved to be true the same would constitute a Contempt of Court punishable in the Federal Court and that he, Mr. McSwain, anticipated that he would probably receive a request at the conclusion of the conference to conduct an investigation by interviewing the Deputy Wardens and exployees about the jail. Agent in Charge McSwain was advised that in the event he did receive such a request from the United States Attorney he would be authorized to proceed with such an investigation. Very truly yours, Vv.
