At approximately 10:00 A.M. on the date that he was hitchhiking in Fredericksburg, Va. he was picked up by an unknown individual driving a 1941 Lincoln Continental Convertible. BURGESS personally drove his car as far as Richmond, Virginia where brake trouble developed and it was necessary to sccure minor brake repairs. These repairs were handicd at the Ford Garage on Broad St. near the Railroad Station in Richmond, Virginia and required approximately one-half hour. During this half hour interval, BURGESS invited Qj to accompany him to lunch "gp upon the completion of the meal BUNGESS paid the bill. During the luncheon, BURGESS consumed a considerable quantity of beer and after the repairs had becn completed, requested that @aiggp do the driving. drove BUKGESS' car on Route 301 towards Petersubrg, Vac, originally observing the 55 mile per hour Virginia speed limit. BURGESS became dissatisfied with @iiie rigid observance of the Virginia speed limit and told him that he apthorized him to drive in excess of the speed limit inasmuch as it was necessary for BURCESS to keep an appointment in Charleston, &- a) At approximately five miles south of Petersburg, Va., MMM was arrested for drivinz BUKGESS! car between 75 and 60 miles per hour. BURGESS attempted to save QM from being arrested by claiming that QM was driving the vehicle for BURGESS and that BUKGESS' diplomatic immunity would extend to The Virginia State Police, however, did not consider that BURGESS’ diplomatic immunity extended .to inasmuch ss a was an American (' citizen who was not employed by the British Government. As an aftermath of the incident, the Virginia State Police set bond at $55.00 and PURCESS, not having sufficient cash on his person to pay this mount, returned to Petersburg, Va. where he cashed a check at a hotel and returned and actually posted the bond required, indicating at the time that - this bond would be forfeited and no appearance in a Virginia court was contemplated.
