It is requested that the enclosed letterhead memo- randum be disseminated to the Department in an effort to convince the Department that GAMBINO is physicall:; capable of appearing at an Immigration and Naturalization Service (INS) hearing. It is further requested that the Bureau, if it agrecs that a hearing can and should be pressed, discuss this matter on a Departmental level which would be in a position to resolve INS' seeming reluctance to proceed against GAMBINO. e any It is pointed out to the Bureau that, in conferences car with INS officials at New York City, it has been determined 4 that their only objection to holding the hearing is a fear AS that GAMBINO may actually suffer a fatal heart attack during if the course of a hearing. INS feels that, if such should i occur, ‘the resulting adverse publicity would overshadow any ql possible good that the hearing would accomplish.
