However, this granting by the FBI of access to the files
has been more illusary than real. My personnel who have
have been told, in effect, that only what they specifically
ask for will be given te them. This, of course, presents
somewhat of a problem when we have virtually no idea of what
information is contained in the Bureau's files on the case in
the first place. Finally, as of late, the agent in charge of
providing our personnel with information from the Bureau's
files in Birmingham has stopped returning my assistants'
telephone calls.
I simply cannot understand the attitude of the Bureau in
acting the way it has in this case, The statute of Limitations
has long run on any possible federal violation that could be
prosecuted in the case, As a prosecutor, I would be more than
willing and happy to provide any information I might have on a
case on which the state statute of limitations has run if there
was any hope of ever bringing a prosecution in another juris-
diction,
As I have said, I trust that your suggestion that we submit
written inquiries to the agents in question is not indicative
of further recalcitrance on the part of the Bureau to provide
this office with information in this case. I am writing this
letter in the hope that you will agree with me that this method
of investigative procedure is totally impractical. I hope that
you will give us permission to interview the agents who worked
on the case before I am forced to pursue an alternative method
of getting the information I feel we need.
We would greatly appreciate your cooperation in this matter.
I look forward to hearing from you concerning our request.
