| “erotica” (literary 6¥ aitistic items relating to sex) from the files of this Bureau
to be utilized by the captioned Institute. On memorandum of November 13, 1959,
in this matter, the Director noted: ‘'In so far as any material which FBI has it is
not going to be made available to this outfit, H., " . a
As the legal representative of the captioned Institute, ion
November 12, 1959, came to the Bureau and asked that (1) Dr. Pomeroy of the
Institute be granted the right to examine "erotica" in the possession of this
Bureau; (2) Dr. Pomeroy be given or loaned "erotica" under restrictions to be
specified; and (3) if the "erotica" cannot be given or loaned_that Dr. Pomeroy
be given copies of the "erotica." It was pointed out to , jby the inter-
viewing supervisor that the official files, documents, and records of this Bureau
are under the regulation of the Attorney General, and that her request would be
passed along to the Department of Justice. This information, along with her
: inquiry by telephone and wire of November 17,1959, and the interview of
i Dr. Wardell Pomeroy of the captioned Institute have been transmitted to the
Department with the statement "No further action is contemplated by this Bureau. "
By letter of December 9, 1959, the attached letter was directed to the
interviewing supervisor. _Anquired whether the addressee had received
any response to "tthe request ior an opinion" addressed to the Attorney General.
_ er indicated in this letter that she wished to expedite the matter,
hoping that "something could be arranged" for one of the next visits/of two officials
of the captioned Institute, Dr. Pomeroy and Dr. Gebhard. A opy of her letter was
