NY 100-81752 Ve TRIAL On march 31, 1952, the trial of the sixteen defendants beran Defense Counsel filed ar offer of proof ehallenging the TS we ek jury panel, cleaiminre that the method of selection discriminated against manual workers, Negroes, and Fuerto Ricans. Hearings on deferdants' challerge to the jury began on April 2, 1952 and ended on April 15, 1°52, when Judge DIMOCK dismissed the challenge and denied defendants' notion for a ninety day continuance, Judge DIMCCK also denied defendants! motion for ten peremptory challenges for each defendant and granted twenty-two challerges to defendants, plus two additional challenges for the alternate jurors. Judge DIMOCh limited the Government to six peremptory challenges and two peremptory challenges for elternate jurors. In the hearines on defendants' challenge of the jury panel, the defendants called as witnesses "JIE LIAM J. BORMAN, Jury Clerk, United States District Court, Southern District of New York, and JAML3 J. DOYLE, Deputy Clerk, United States District Court, Southern District ef New York. The Government called DAVID L. KAPLAN, Chief of Occupation and Industries Statistics Section in the Population and Housing Division of the United States Bureau of Census, The impaneling of the jury began on April 15, 1952 and was completed on April 23, 1952, when twelve trial jurors and four alternate jurors were sworn. On April 22, 1952, Judge DINOCK cranted JAMES T. WRIGHT and Mrs. MARY bh. KAUPMAN of Defense Counsel the right to make opensne statements to the jury after the conclusion of the Government's case.
