Omni 1 - Mr. Cleveland This is being furnished in answer to the Director's inquiry regarding the 9 millimeter jacketed bullets which were found in the. victim's apartment. On 2/5/74, in the first search by SAs of the FBI of the victim's apartment which is apartment #4, 2603 Benvenue, Berkeley, California, a box which contained 25 cartridges of 9 millimeter caliber, Parabellum (Luger) was located. It is noted that the victim's apartment was previously Searched on 2/4/74, by the Berkeley Police Department (BPD). In the search by our Agents, the box of cartridges was located | underneath a bookcase. ASAC John Kelly, San Francisco, who has seen the victim's apartment, advised that the box of cartridges could easily have fallen from one of the abductor's pockets when he reached down near the bookcase to pick up the wine bottle which was used to strike Weed. The cartridges could also have been kicked underneath the bookcase in the © scuffle in the victim's apartment and not located in the first search by the BPD. These cartridges were apparently dropped by the abductors during the scuffle in the apartment since the victim's fiance, Steven Weed, stated he never saw the ammunition before -— and is certain there was no ammunition in the apartment prior to the kidnaping.
