. In the early morning hours of January 10, 1974,
Sergeant D. Duge of the Concord, California, Police.
Department stopped a 1965 Chevrolet, red colored van, —
California license 806 GUD, reaistered to a Nancy Gale
Lina and driven by Russell J. Little with passender Joseph
Michael Remiro. Little was in possession of a drivers
license in the name of Robert James Scalise. The van was
stopped near the intersection of Sutherland Drive and Ayers
Road in Contra Costa County, California. The Concord Police
Department also services the adjoining municipality of ,
Clayton and in this general area there are some streets that
are in the unincorporated area of Clayton Valley. Serqeant
Duge questioned the driver of the van as to their destination
and received an answer that they were attempting to find
the home of one Devoto on Sutherland Court.
Dude checked with control and was advised that
the cross street index showed no listing of a Devoto on
Sutherland Court. The officer reapproached the van and
Remiro exited from the passenger side of the van and there-
after fired two shots at the officer. The officer retreated
and there was a further exchange of shots. Remiro fled on
. foot and Little drove off in the van but was stopped a short
: . @istance away by another Concord police officer. Upon arrest
it was discovered that Little had been grazed in the
shoulder area by a bullet. 27 Smith and Wesson .38 special
‘ cartridges were taken from his jacket and a .38 Detective
SS Special was on the top of the vehicle's internal engine
, cover between the seats.
Some four hours later Remiro was arrested on foot
: in a driveway at 5076 Sutherland Drive, Contra Costa County.
: He was still in possession of a Walther 9 mn. automatic,
Nodel PP, serial number 444358. At the scene of the shooting
.380 super vel casing was found. The van was also found
to contain a rifle and a larae number of SLA pamphlets
bearing the SLA seven headed cobra insignia on the first
_ page. Ballistic examination has ascertained that the .380
in Remiro's possession was the gun used to kill Marcus
Foster and firearms records indicate the weapon was purchased
by Remiro.
