MILLER detennined that SCOIT was receiving a great deal of pressure from tenured factflty members at Oberlin. This was due to SCOTT'S unorthodox manner of administration as Athletic Director. , During the last part of May; 1974, MILLER'S employment at Stockton State College ended. At approximately the same time, SCOTT'S employment at Oberlin also ended and SCOTT and his wife moved to an apartment in New York. SCOTT did not have a job but was working on a book. He was also not in a financial crises inasmuch as he had made a sub- Stantial settlement with Oberlin upon the termination of his job. In late June or early July, 1974, MILLER received > a call from SCOTT who indicated that he was in Califomia. SCOTT suggested that MILLER and MILLER'S son some to California and visit him, and thereafter, drive back east with unnamed friends of SCOTT. In this regard, SCOTT told MILLER that reservations had been made by SCOTT for MILLER and his son with either American or United Airlines. MILLER declined this offer as he was planning to travel to France on July 25, 1975. MILLER did not consider anything unusual about this request inasmuch as it came from SCOTT who MILLER “knew to be a ready traveler. . Prior to his departure for France on July 25, 1974, ~ MILLER stopped at SCOTT'S apartment in New York. “This was a few days before July 25th. Both JACK and MICKI SCOTT were present at the apartment. During that one night visit, SCOTT said that he had secured a farmhouse in the country in New York. SCOTT did not elaborate on this and MILLER did not pursue the matter. Upon returning from France on August 18, 1974, MILLER again stopped at the SCOTT apartment. JACK was not there and MILLER visited with MICKI.
