While the male was shopping in the clothing section, SHEPARD heard the erinkling of cellophane and believed he - observed him putting something up his sleeve. SHEPARD presumed he had put a pair of socks up his sleeve, but he cid not know for certain the type of merchandise he was attempting to shoplift. At this point SHEPARD went to the rear of the store to. obtain a .38 caliber pistol which he put in his right “pocket. Then, he alerted store owner, BILL HUETT, and employee GARY MASON that he thought he hed observed a shoplifter and for them to be ready if he called. . oy When SHEPARD returned from the rear of the store the male asked if they sold air horns. SHEPARD replied no, but they did have extra cans of gas for air horns. SHEPARD told him he could check on the air horn but the male. said, "Don't — ‘ bother", ; . At this point the couple came to the: checkout counter with the following items: | One ammunition pouch — ; a ee . Two pair white sweat socks
