SiA\TEMENT ; , Each section of the bill furnishes a specific necessary authorization in substantive law to support a apreific part of av appropriation, 1t has been a past practice to support such appropriation by legislative language in the amiual appropriation act for tho Department of Justice. ; ot 1 From tho standpoint of legislative practice, this rule of legishuting was at all Limes subject to a point of order, It is the opinion of the committee thet the situations contemplated in the various sections of this bill are such that the objections of «2 point of order in an appro- priation bill should be obviated and that such an appropriation is Necessary. _ This bill was introduced at the request. of the Department of Justice in a Jetter to the Speaker of the House of Representatives dated April 19, 1949. House of Representatives, Washington, D.C. , My Dear Mar, Spraxen: In order to preclude the raising of points of order against the Department of fustice appropriation bills on the ground that certain expenditures provided for therein have nat previously been authorized by law, it is recommended that Iveislation be enacted to supply substantive law for such recurring items. : . At the request of this Department, 9 bill CH. R. 2967) desiencd ta accomplish . this purpose was introduced in the Kightioth Conaress, A draft of a bill is enclosed which is designed to meet the present needs of the Dopartment in this reepect. . Section 1 af the draft would make the appropriations for the Department of Juatice available for the payment of notarial fees, ieluding necessary stenoezraphie acrvites, the compensation and expenses of witnesses and informants and, when ordered by the courl, the experises of meals and lodging for marshals, deputy marshals, or eriers in attendance upon juries, The authorization for the payment of stonoeraphic services was included to cover cortnin objections of the Comp-_ trotler General that notaria} fees alone are availabic for payment fer reducing - testimony to writing (13 Comp. Gen, 330). Section 2 of the draft would authorize the payment of necessary expenses ineidend to the transfer of prisoners in the custuctys of marshals to narcotic farms, Tt fs designed io dive effect in substantive law forca provision contained in the appropriation act for United States marshals for the fiscal year V4 without changing existing procedure of practice. .
