Piaintift has served upon Jeanne Mohr Scott
"interrogatories" purportedly in accordance with Rule 33 of
the Civil Rules of this Court. Said Jeanne Mohr Scott is not
a party to this proceeding.
Rule 33 of the Civil Rules of this Court states, in
part: °
“Any party may serve upon»
any other party written
interrogatories, . .:."
Thus, written interrogatories are appropriately served under
Rule 33 only upon parties.
In the case of non-parties, an examination of a
witness may be made by written guestions (as opposed to inter-
rogatories) under Rule 31 of the Civil Rules of this Court. fhe
distinction is not merely one of form. Under Rule 3i(b), there
is to be an officer who actually takes the deposition of the “
witness, in the manner provided under Rule 30. <A record is to
