been drown up by errsan instructions of ELSHOFF. At this time, definite
proof was obtaincd ostablishing tho association of these men with the
Unitcd Hine Workers and five of them wore expelled sometime previous to
May 12, 1937, namely: PETE CARTER, ANDREW SERELEVICUS, DOMINIC PASQUALE,
JOE SLEANSSE end FRARK AUSTIN. I was active, along with other members of
Local Union #54, in bringing the charzes cgpinst these five men which resulted
in their expulsion from the Progressive Mirsrs of America. In accordance
with tho policy of such matters, it was -uferrod to the Pit Committee, who
was to take it up with tho Management relasive te the discharge of those
five members in accordance with the acecpted practico under the closed shop
contract with the compony.
"J did not actively tare part in the demands which wero made of the
linnegement on the morning of May 12, 1937, I did report to work and 2 knew
thesc men who reported to work also. In fact, I saw FRANK AUSTIN and PETE
CARTER. I told FRANK AUSTIN that he nad beon expelled from the organization
and that he had no business out there. I also met PETE CARTER and asked him
what he was doing thore, I asked him if he kmew ho had heen expelled and he
said, “Yos." He said he had to cat and wos going to work there until he was
laid off. I worked that dey and londed at least two short cars, It was my
understanding that this was done gencrally over the mine as the miners did
not want to strike but fcolt if they would siow down the production some
they could persuade the Mansgcement to come to their terms and discharge theso
five men without strike. About an hour before quitting time, the company
stopped hoisting cosl. I went to the top cad fornd that thore had been a
disagreement between the operator, CARL ELSFOFF, and the Board Membo
=a I am not in position to say whether Wi had called a strike or
ELOHUFF had ehut off production.
"the mine did not work any more after Mey 12 for sometime. Pickets
remained at the scene of the mine on tho oil read about a quarter of a mile
from tho mine until the carly part of June, 1937. Thia was done in order
to make sure that United Mine Workers did not import strike breakers to tako
our jobs. It was during this period that I, personally, saw
whom I know to be a United Mine Workers investigator and gum man, drive
that vicinity with at least five other cars full of mon, whom we identified
by license numbers as individuals from the Kincaid crea there the Poabody
Mine operated under contract with the United Mine Workers.
