Feceral Juige Merrill EB. Otie appointed John G. Madden, Fidelity
National Bank Building, a reputable attorney of Kansas City, as
Counsel for Subject Mre. Frances°Nash. Mr. Madden filed a habeas
corpue petition praying for the release of Frances Nash, alleging
that there ise insufficient evidence to further hold her in the in-
stant matter. The.petition was presented in open court on July 26,
1933, and Judze Otie teok same under advisement. He will rule on
the petition within one or two days.
4t the present time, a resume of ail data in this case, which would be
suitable for the United States Attorney and to be used by him in the
preliminary heerings, scheduled for July Slet, is being prepared. In-
formation which came through various confidential informants will, of
course, be etated only in substance, and the source will not be referred
to.
In the instant report, ae in others, undeveloped leads are not being set |
out, but letters are being written to the respective offices concerned, ©
after the report hae been written, referring to specific pages, with
request for certain investigation. It ia recommended, however, that the
‘offices which tave to date received requests for investigation in this
matter carefully examine the entire report and take action pursuant to
any poasible leads, which may develop in thos respective territories.
Since July 18th, investigative action has been had in the territory of
Hot Springs, Arkaneas, and based thereon the following memorandum has
been rendered:
