MEMORANDUM FOR THE DIRECTOR.

Agent in Charge Conroy called from Kansas City and Ser
stated that this morning the court had reduced the bond ofgStacey,
who is being held on the obstruction of justice charges, to $5000.
Attorney Henry R. Balaban, former Assistant United States Attomey .
at Chicago, who represents Stacey, was in to see Conroy this morning
and requested permission to confer with Stacey, which Conroy granted.
Subsequently Baleban called Conroy and advised him that he had found -
Stacey in practically solitary confinement and requested thet he be
renoved from this sort of a cell and placed in the ordinary cell for the
two or three days which it will require to make the $5000 bond. Conroy
said he felt that this was a reasonable request inasmuch as Stacey
undoubtedly will meke the bond; that we wight as well make & gesture
of good will by agreeing to the removal from solitary confinement.

Conroy stated that he had talked to Stacey several days
ago &t which time Stacey had told him that if he could be promised
immunity he would be glad to assist the Division with all of the
information he had and he felt that he could hook one man definitely
into the Kansas City massacre. He would not intimate who this man
was but Conroy says he feels it is Miller. Conroy, of course, told
him that he could not possibly give him any such promise but Conroy
stated that he would continue, of course, to keep in touch with Stacey.
I asked him whether Belaban had shown any disposition to have Stacey
talk end Conroy stated that Baleban's attitude was very good. He did
not promise anything but stated that he felt that Stacey would be —
inclined to help the Government, particularly if he is given just a
little consideration at the jail et this time. Conroy stated that
Belaban is to call him back at three o'clock and Conroy would like to
heve word from the Director prior to thet tine.
