Re: VEXNON C. MILLER, with alieses, Fugitive, I. 0. 1195, et al;
Obstruction of Justice. {Endeavor to Deliver Federal Prisoner

In accordance with instructions and with reference to my manorandim
of November 2, 1933, in connection with the above captioned matter, I beg to
submit the following concerning instructions given to Special agent W. 4. Smith
shortly previous to the time that Verne Miller came out of Apartment 211 on
November 1, 1933:
As referred to in Paragraph 3 on Page 5 of my previous memorandum,
at approximately 8:30 P,lMd., Nowanber lst, at which time it was thought Miller
might possibly came out of the apartmant, I instructed Special agent W. 4. Smith -
® go dometairs and cover the lobby and the Sheriden Street entrance to the
Sherone Apartments, and ales to notify agents Rice and Lockernan, who were
stationed on Galt Avenue covering the Galt Avemie entrance to the Sherone Apart-
ments, to be on their toes as we expected Willer might leave his apartment with-
in a short time. The lobby in the Sherone Apartments ia amall and the stairs.
leading from the upstairs ere about ten or twelve feet from the Sheridan entrance
to the apartment, sco that the stairway end the Sheridan entrance can be observed
by a person standing in the lobby.
after giving Agent Smith these instructions, I returnel to the
kitchenette, in order to be able to be in a position to definitely ascertain
if Miller were the paraon coming out of the apartment and eo as to be in a
position to signal Yan Wagoner in the living room. A few minutes after I
returned to the kitchenette, I observed Agent Gmith leaving our apartment and
proceeding downstairs. I was later informed that Smith had been detained fran
golng downstairs by the agents, es they believed that Bobbie Moore might be
yeturning to Apartment 211. Shortly after agent Gnith left Apartment 207,
Miller came out of Apartment 211 and the events following that have been pre-
viously related.
At the submission of my first manorandum I had not talked to Agent
Smith, bat I have since talked to him and he informed me that after being in-
atructed to go downstairs to cover the lobby and the Sheridan entrance and to
inform Rice and Lockeruan to be on the lookout, that he went to the door of
£07 and was detained there for three or four minutea by the Agents at the door,
ae they were afraid that he might bump into Bobbie ioore; thet when they did
open the door, he proceeded down the steirway to the lobby and went out the
Sheridan Street entrance and around the corner to the right, for the purpose
of advising Rice and Lockerman that we expected Miller to come out sieortly,
Dut because of the delay upstairs, Miller had cane out of the apartment and
