. This Agent, in company with officer Donovan contacted
Nr. Fe L. Ray, 945 Gelt Street. Mr. Ray is the occupant of the
second floor apartment rear at this addrese. Agent asked Nr. Ray
whether or not he would object to several officers and this Agent
watching the Sherone Apartments from this apartment, and he stated
that he was glad to cooperate and would do averything possible for
&ny men who desired to come in there. after this arrangement had
been made this Agent called Acting Special Agent in Charge D. 0.
Smith on the phone and advised him that it had been agreed between
Stecial Agent Guinane and the others at the Sherone Apartments that
we were to take Verne Miller at 5:00 P.M. Acting Special Agent in
Charge D. 0. Smith stated that it would be all right to take Verne
Milier'’s apartment at 5:00 P.M., provided positive identification
could be mace. He also stated that he would leave further action to
the discretion of Special Agent Guinane.
This Agent then proceeded to Apartment 207, Sherone
Apartments, and advised Special Agent Guinane of what had taken place
and it was then agreed that this 4;rent should contact Agent Ryan,
obtain & mechine gun from him, and bring it up to the back way of
the apartment occupied by F. L. Ray. The machine gun was procured
from Special Agent Ryan by this Agent and brought up to the Ray
apartment.
This Agent then contacted officers Donovan, Pidgeon,
and Lynch and together with them went to the Ray apartment. Officer
Lynch, with a machine gun, covered the two rear windows of Verne
Miller's apartment. Officer [Donovan covered the side window of Verne
“iller’s epartment, and this Agent, together with officer Pidgeon
covered the fire escape and alley way leading from the hallway adjacent
to Verne Miller's apartment. This Agent and officers Lynch, lonovan
and Fidgeon were in the above positions for about tw hours when re-
volver shots were heard on Galt Street, which is about fifty feet
from the apertwent occupied. The first four shots were heard at inter-
vals of about three seconds, and tien a machine gun was heard, and in
the opinicn of this Agent about sixteen to eighteen shots were fired
from the machine gun. The writer and the officers referred to above
remained in the sane positions for about five minutes, at which time
thie Agent advised the officers to remain in their positions and to
still cover the spots assigned to them, while this Agent ran down-
stairs into the street. .
when this agent arrived on the street there was a large
crowd gathered there and this Agent observed Speciel agents Lockerman
