en escaped convict. The Board accepted the matter rather favorably
and indicated that after reviewing the law they would advise me ae
to whether or not the expenses could be met from priaan funda, I
aw inclined to believe that they will pay the expenses chargeable
to Underh{11. However, with respect to the expenses in connection
with Ralph. Rowe, whose hospital bill was $20.50 end whose doctor
bill for an operation in removing a bullet was $30.00, I do not see
how the atate can be asked to pay that. The seme thing applies to
the case of Eva Mae Nichols, whose heapital bill amounts to $16.50
am doctor bill until death, $15.00. It seems to me that it is
entirely up to the Department or Division to pay these expenses in
some manner. I realize that the lezal aspects of the thing are |
difficult.
At the time these persons were placed in the hospital, I
was called in by the city manager of Shamee, Oklahoma, which
municipality owna the hospital, and asked as to whanwould he look
to for payment of the hospital bille. I waa practically forced to
tell him that the Department of Justice would be responsible. It-
was impracticable to tell him anything else for the reason that the
people had to be taken care of and no one else would assume the —
responsibility in the matter.
As soon as I hear from the State Boerd of Affaire, I will
eivigsa you further, but in the meantime I wish the Division would
give this matter eane further study and ese if a wey can not be
evolved to pay the expenses in regarf to Eva Mae Nichols and Ralph
Rowe. I personally feel a mora) responsibility in the matter but
can not, of course, pay these bills individually.
