Merlow told me that he ia not in position at this time to know
whet hie informant can or will do in respect to this matter. The informant
resides more than 150 miles from Chickasha, Oklahoma. At my request,
‘arlow promised he would contact the informant at an early date.
Op Saturday, March 3, 1034, Mr. Marlow passed through Oklahoma
City and tole me that he was proceading that dey to contact his informant
in Seninole County, and would let me know immediately when he returned to
Oklahoma City what he found out.
On Sunday moming, Maren 4, 1934, Mr. Marlow informed me thet he
had learned in Seminole County that his informant recently had

This informant told us frenkly that he knows Charles Floyd, that
bid former partner of Floyd, was related to him,
and that fomerly Birdwell and Floyd made frequent trips to his house; that
while he had not herbored them, so to speak, he had entered no objections to
- their coming to his home for the reason that he was afraid to, but now that
Birdwell is gone, he has no interest in Floyd, but that the latter has not
been to his Louss sines about the time he kidnaped the Sheriff in Nissouri
lest summer which was- June 16, 1933; that he does not, at this time, know
the whereabouts of Floyd, but he believes possibly that he could ascertain
that information within a reasonable time. He made no definite promises
that he could learn the whereabouts of Floyd, but said that he believed he
could, and that it was not his desire to tell us that he could do something
that he would bea unable to do. He stated that he has made and solid liquor for
& number of years, and that this haa been the extent of his criminal activi-
ties, and thet this la generally known by the enforcement agencies in his
community. This, too, ia born out by Marlow.

This informant is different than the average “jailbird" who ia de-
“ sirous of furnishing the office with informstion in that not one time did he
en beseech Gs to use our influence to get him out of jail, and he was not
Paiawe expressive of a whole lot of bitterness, but did sey that he thought hia sen-
tence was not commensurate with the offense he had committed for the reason
that he was found in possession of only one gellon of whiskey.
The iuformant told us that he realized that thia was a dangerous
undertaking, and while he could not promise any definite results, he would be
willing to try to ascertain the infomation with respect to Floyd. He stated
