Memorandum to Mr, Belmont Re: UNKNOWN SUBJECTS; MICHAEL HENRY SCHWERNER, ET AL. Katzenbach that I did not see how the subpoenaing of any witnesses would affect the outcome of the case and that anyone the attorneys desired to subpoena could be subpoenaed, In this connection the attorneys have furnished a list of names of individuals who they desire to have subpoenaed, We will assist in the service of the subpoenas where they are not readily located inasmuch as the attorneys are at this time interviewing all potential witnesses, This could very well be a "cute" way of trying to find out who our source may be and I believe that the question of perjury is inconsequential in the over~all consideration of the case, RECOMMENDATION: Taking everything into consideration, I feel that we should state to the Department that insofar as we are concerned the attorneys trying this case are free to ask any questions which they may desire to and that we are not placing any restrictions on questions that they ask nor the individuals they subpoena just as long as it comes within the accepted prerogatives of legal procedure, Inasmuch as we have now been pressed for some answer, I believe it would be appropriate to state ‘We were.able to secure information leading to the location of the bodies; ‘however, the source cannot be disclosed." This is a specific answer and would be appropriate under the circumstances. If cir stances change, then we may have - to suggest further action. Thig/wil)/be watched closely.
