On February 28, 1958, subject, through his attorney,
DAVI! IN, of the law firm of Forer and Rein, Washington, D. C.,
filed a complaint in United States District Court for the .
District of Columbia, in civil action number 513-58, entitled
“PAUL ROBESON, 16 Jumel Terrace, New York, New York, Plaintiff,
v. JOBN FOSTER DULLES, Secretary of State, Defendant. " The
complaint states that subject is an artist, specializing in
Singing and acting for more than a quarter of a century. It
---- --gtates that subject's income in large part has been derived from
concerts and appearances in Europe and elsewhere in the world.
It was stated that on or about August 1, 1950, the Secretary
of State made a public announcement that plaintiff's passport
had been revoked, and on January 30, 1953, and thereafter,
Plaintiff made applications for passport, the last such
application having been made on March 21, 1957. It was stated
that each of plaintiff's applications for passport were denied
by defendant based upon political beliefs and associations and
upon plaintiff's refusal to answer questions on those subjects
it was also stated that on May 29, 1957, plaintifi appeared
at an informal hearing, defendant was the sole witness and
relied upon confidential material, not disclosed to plaintiff,
upon testimony of witnesses before congressional hearings and -
upon newspaper stories. The complaint alleges that the
constitutional rights of plaintiff have been violated through
the refusal of defendant to issue’ plaintiff a passport and that
this refusal interferes with plaintiff's liberty and was done
without due process of law. The complaint contends that the
questions in the passport appl jeation rel ating to nembership
in the Communist Party have no retevance to plaintiffs’ request
for a passport, . . 1
On July 2, 1958, a stipulation was entered by
plaintiff's attorney, DAVID REIN, and defendant's ‘attorney,
JAMES C. HISE. This stipulation reflects that plaintiff and
defendant by their counsels stipulate as follows:
