AFFIDAVIT
Your co-affiant, Christopher R. Braga (“Affiant Braga”), is a Special Agent
(“SA”) of the Federal Bureau of Investigation (‘FBI’), U.S. Department of
Justice. Affiant Braga is currently assigned to the Violent Crime — Major
Offender’s Squad, of the Baltimore Field Office. Affiant Braga has been
employed by the FBI for 5 % years and is currently assigned to the Violent
Crimes-Major Offenders Squad of the Baltimore Field Office responsible for
investigations of bank robbery, extortion, kidnapping, homicide on federal
property and reservations, and other criminal matters.
Your co-affiant, Scott E. Riordan (“Affiant Riordan”), is a Special Agent of the
Bureau of Alcohol, Tobacco & Firearms (“ATF”) and has been so employed for
the past 4 % years. In that capacity, Affiant Riordan is responsible for
investigating federal crimes, including crimes of violence and crimes relating to
firearms and ammunition.
This affidavit is being submitted in support of a complaint to charge JOHN
MUHAMMAD, a/k/a “John Williams”, a/k/a “Wayne Weeks”, a/k/a “Wayne
Weekley” whose date of birth is 12/31/60 (“MUHAMMAD”) with violations of
18 U.S. Code, Section 371, Conspiracy to Commit Offenses Against the United
States; 18 U.S. Code, Section 1951, Conspiracy to Affect Interstate Commerce by
Extortion and Threats of Physical Violence; 18 U.S. Code, Section 1951,
Affecting Interstate Commerce by Extortion and Threats of Physical Violence; 18
U.S. Code, Section 1952, Interstate Transportation in Aid of Racketeering; 18
U.S. Code, Section 922(q), Discharging a Firearm into a School Zone; and 18
U.S. Code, Section 924(c) and G), Use of a Firearm During Commission of a
Crime of Violence, Causing Death of a Person.
This affidavit does not contain every aspect of the investigation, but only those
facts necessary to establish probable cause.
This affidavit is based on personal investigation by your Affiants as well as
information provided to us by agents of the Federal Bureau of Investigation,
Bureau of Alcohol, Tobacco and Firearms, the Montgomery County Police
Department and other members of law enforcement.
On October 2, 2002, at 5:20 p.m., Montgomery County Police in Montgomery
County, Maryland responded to 3800 Aspen Hill Road! for a shot fired through
the window of a crafts store. At approximately 6:04 p.m., on that date, at 2201
Randolph Road, in Wheaton, Maryland, James D. Martin was shot in the back
and killed. This occurred in a parking Jot of a Shopper’s Food Warehouse. On
October 3, 2002, at approximately 7:41 a.m., James L. Buchanan, Jr., mowing the
lawn at a car dealership at 11411 Rockville Pike, Kensington, Maryland, was shot
and killed. At approximately 8:12 a.m., on that date, at 4100 Aspen Hill Road,
