subcommittee on Merch 80, 1951, to which
Benator McCaRTHY replied:
“This is tc acknowledge receipt of your
letter of March 30. in which you state that
the subcommitiee understands I do not wish
an Opportunity tu appear in connection with
the Maryland hearings
“I have not read any of the testimony
taker before the comrm{ttee except those
Portions reported in the newspaper, nor have

To thls letter the subcommittee replied

“Since our hearings are stil continulng the
Bubcormmittee cannot at this time presume
tO pass upon the testimony of any Witness
Or group of Witnesses who have appeared
before it, That action. as you know. must
necessarily follow the development of all ms-
terial facts and after careful analysis of the
record.
“The purpose of our earlier letters was to
offer you an opportunity to be heard if you
s0 desired. The present scheduie of witnesses
Suggests we may conclude our hearings Wed-
nesdey. April 11, 1951.”
No further communication was received
Trom Senator McCartHy. He was not called
&S a witness nor did he appear in response
to the invitations While there was no duty
upon him, under the circumstances. to tesiity
at this hearing. the prominence of his per-
sonne. in the antl Tydings campaign and the
activity attributed to the Senator himse!f by
certain witnesses might properly have been
explained by him From the testimony !t
appears Senator McCarTHy was a leading and
potent force in the campaign against Serna-
tor Tydings.
The VICE PRESIDENT. The resolu-
tion will be received and referred to the
Committee on Rules and Administration.
The resolution «S. Res. 187) submitted
by Mr. Bexton was referred to the Com-
mittee on Rules and Administration, as
follows:
Whereas the Subcommittee on Privileges
and Elections of the Committee on Rules
and Administration has made a unanimous
report to such cammiuttee with respect to the
1950 Maryland senatorial genera; election;
and
Whereas such report contains findings with
respect to the financing of the campaign of
Seastor JOHN MarsHact BUTter, as follows:
“1. AS g result of the investication and
hearings of this subcommittee, Jon M. Jon-
kel, the campaign manarer of Senator But-
LER, has been indicted. plead guilty tc. and
ha: been sentenced for, violation of the
Maryiand election laws for failure to proper :y
report contributions and expendiures in ihe
Butler campaign
“2. Not only were substantial sums of con-
tributions and expenditures not properly re-
Ported to Maryland suthorities as required
by jaw. but also a proper accounting was
not made to the Secretary of the Senate as
required by the Federal Corrupt Practices
Act": and
Whereas such report, with respect to the
literature used in the campaicn of Senater
JoHN MaxsHaLt BcTies, contains findings us
follows:

Misleading half truths. misrepresentations,
and false innuendos that maliciousy and
without foundation attack the loyalty and
patriotism mot only of former Senator Mul-
lard Tydings. who won the Distinguished
Service Cross for battlefieid heroism in Word
War I. but also the entire membership of
the Senate Armed Services Committee in
1950.
“2. Its preparation. publication, and dts-
tribution were the resuit of a combination
of forces, including Senator Burer’s own
Campaign organization.
"& The tabloid, di
eency and common hone . Was designed to
create and exploit doubts about the loyalty
of former Senator Tydinces.
“4. It could mever have been the intention
of the framers of ihe first amendment to the
Constitution to a:iow, under the gulse of
freedom of the press, the publication of any
portrayal. whether in picture form or other-
wise, of the character of the composite pite
