Considering the delicacy of the business _in which the Loyalty Review Board is cn- gaged, this leakage would be intnierable ‘in connection with any outsider. In view of Senator McCarthy's demonstrated lack of scruple in turninc—and often twisting— confidential information to his own political -advantage, it is peculiarly dangerous and damaging, The tse that Senator McCarthy has made of the material divulged to him from within the board is on a par with his exploded name-calling in the past. He says that con- fidential files show John Stewart Service ‘lived for two years with “an Loionaxe agent... on the payroll of the Soviet _ government.” Considering the laxity with which the Senator applies the term “espi-’ onage agent,” this might well mean no more than that he had lived for two years with ‘Gen. George C. Marshall. The “agent” is not identified, {he source of the story is ‘not disclosed, and no supporting evidence whatever is offered. Similarly, Senator McCarthy declares that ‘he was informed by “at least two members” of the Loyalty Review Board—also un- identified—that a majority of the board felt that if they had been able to order a dis- charge for security reasons, Ambassador- at-Large Philig, Jessup “would have been discharged.” “These two “members’—if they exist at all—are certainly not author- _ized to speak for the board, or to conjecture ‘about hypothetical decisions; and the board thas no authority, of course, to make judg- ments outside the terms of the executive order establishing the loyalty program. In the case of David Hoya, a highly-re-. spected special assistant te the President, ‘the McCarthy technique was applied in a peculiarly despicable way. Allegations con- cerning Mr. Lloyd were made in 1950— iby Senator McCarthy. Because these allega- itions, wholly unsupported, were not con- isidered sufficiently substantial to warrant formal charges and a hearing, the Senator ‘Dow says they were dismissed as the result (of pressure from the White House. No ‘one, it would seem, can be cleared once ‘Sensor McCarthy has accused him. { It bs plain that some person, or persons, insidg the Loyalty Review Board is giting ‘Classified material to Senator McCarth and is thus guilty of one of the specie activities which the executive order directs 65 JAN 251952 ( the Loyalty Re ew Board to conic connection with the determination of dis- loyalty — “intentional, unauthorized “diselo- sure {0 any person, under circumstances” which may indicate disloyalty to the Uniled . §tates, of confidential documents or infor- mation obtained as a result of Government , employment.” In short, until it cleans its own house, the Loyalty Review Board can- not be considered qualified to pass upon the loyalty of other Government employes, A cloud hangs over the board.
