yO This memorandum was referred to me for comment at 9:34 a:m. on —._
June 10, 1977, by Mr. Revell, Executive Assistant to the Associate Director. / ~
Title 28, Code of Federal Regulations, Section 17.55, provides for ‘a
report to be made to the Security Officer of the Division (FBI); to the Security
Officerof the Department; and to the Department Review Committee concerning
possible compromise of classified national security information or material.
There is no provision in that section calling for specific notification of the
Attorney General of possible compromise of such information or material..
Further, the three items described in the memorandum (Ayers case; Chicago
memo 8-20-76; and Kearney's Discovery Motion) appar ently have been made
available to the Department previoisly. My opinion is that if this memorandum
addressed to the Attorney General in order to accomplish that purpose. If the -
memorandum has some other purpose which justifies it being sent to the Attorne
General, such other purpose could be more clearly expressed in order to avoid
pessible misconstruction by the Attorney Gener
