Kelley Director Federal Bureau of Investigation Washington, D.C. Dear Mr. kelley: Reference 1s made to your letrer, dated July 27, 1976, which was delivered to me on August 3, 1976. AS you may be aware, on June 18, 1976, an individual, identifying himself as William L. Gardner, Chief, Criminal Section, Civil Rights Division, United States Department of Justice (USDJ), Washington, D.C., advised me on the telerhone ‘that his Division had the responsibility for an investication being conducted concerning surreptitious entries made without judicial approval in residences and other buildings which could be violations of Title 18, Sections 241, 242, and 2236, United States Code. Gardner stated that he was in possession of infor- mation that I may have had a role in such entries on cne or more occasions. Therefore, I was being considered a potential subject of this investigation. In short, Gardner requested that I travel to Washington, D.C., to be interviewed by him in this matter, at which time I would be advised of my Consti- tutional rights as a subject. He advised that he desired to have this interview conducted as quickly as possible and would appreciate it if I or someone acting on my behalf contact him to arrange for the interview and the conditions under which I would be interviewed, ' I told Gardner that at this point, I was undecided aS to whether or not I was in need of counsel.
