Pr clearance and therefore if I did decide to obtain legal counsel, I could not proceed in selecting an attorney and advising him of possibly pertinent facts. I told him that other matters and problems of a similar nature were still being resolved at the Federal Bureau of investigation Headquarters (FBIHO) and USDJ level which would have a bearing upon my decisions as to choice of counsel. Gardner advised me that he had on that very day learned of the problem concerned with divulging classified information to independent counsel, Other similar matters concerning the possibility weaves au Ponwngonad maect ¢ or my interview were aiscussea, notably the possible use of a Grand Jury proceeding in New York City in order to obtain a statement from me in this matter. I was also left with the impression that Gardner would recontact me at an unspecified date in the near future. I have not been recontacted by him since our discussion on June 18, 1976. Concerning your July 27, 1976 letter to me, I can only regard it as a reiteration and confirmation of your previous instructions as set forth in your teletype message of June 17, 1976. in regard to providing information to counsel of my choice, there has never been any doubt in my mind that such information would be of a highly classified nature per- taining to national security matters. Due to the fact that I have never been advised by the USDI as to the specific facts which have led the USDJ to consider me a potential subject, I have been put in the potential position of necessarily having to be as liberal as possible in providing information to counsel in an attempt to anticipate the scope of an interview with Mr. Gardner. Therefore, the probability cf divulging classified information to counsel, becomes proportionally greater with the amount of information furnished.
