DETAILS: When the CRD's investigation into surreptitious
entries waS initiated, we were furnished a list
of Agents who were considered subjects of the inquiry. Many
of these Agents contacted FBIHQ advising they were consulting
private counsel and were desirous of being released from
their employment agreement. At this time, a letter was
prepared by Legal Counsel Division which it was felt
would suffice for this purpose.
On 7/29/7 Atlanta Division,
telephoned Legal Counsel Division to report a contact by
a representative of the CRD is representative stated
that he desi oO speak to concerning the CRD's
—_———— aa that he informed the Department
representative that he desired to consult with private
counsel, and that he was contacting the Legal Counsel Division
to request a release from the provisions of his employment
agreement. On 8/ 9/76, we forwarded the above-mentioned
letter. This let.er uses the sentence, “The CRD has
requested me to advise
counsel, if you have not already done so." This sentence
was based on discussions between representatives of the
Legal Counsel Division and the Department.
By letter dated 0/13/71
took exception to this sentence and stated that he
believes it prejudicial, as it implies that he
is being investigated as a subject. He requested that
our letter be removed from his personnel file and
the record be made clear that he was contacted by the
Department for interview only.

The letter which was prepared by Legal
Counsel Division for submission to Agents who have requested
release from their employment agreements was designed to
fit all categories, i.e., subject or witness, and was
not intended to infer that anyone was a "subject," “suspect,”
