Category number 8, regarding the “identity of
all FBI personnel who took part in the entries, and any
person who approved or recommended such entry," may be
answered by identifying (1) the Field Supervisor and
highest approving authority in the field office who to-
gether recommended the action to FBIHQ, (2) the FBIHQ
case supervisor and highest approving Bureau official
who together approved the activity for a field office,
(3) approval of the Attorney General on the appropriate
date, and (4) the identities of the Special Agents who
actually took part in the installation, or survey.
With respect to (1) and (2) in the foregoing
Paragraph, Mr. Allen recognized that on some occasions
officials such as Relief Supervisors, Assistant Special
Agents in Charge, Night Supervisors, #1 Men, etc., would
approve field communications to FBIHQ recommending surveys
and installations, and subsequent FBIHQ authorizations to
the field. Where appropriate therefore, the identity of
the individual signing a communication, and for whom,
should be noted.
With respect to the identities of Special Agents
who took part in the actual survey and installation,
Mr. Allen was advised that FBIHQ and field office files
normally would not reveal this information. Mr. Allen
inquired if the data might be obtained through recollection
of field office Special Agents assigned to the appropriate
areas of investigation. He was advised that in a number
of instances, the information might be obtained by this
method, although retirements, reassignments, and deaths
of Agent personnel would undoubtedly hinder the attempt.
Mr. Allen indicated the Bureau should make a reasonable
effort to secure the requested identities.
An additional area of question; namely, the
lack of any indication in FBIHQ and field office files
that a trespass or entry was committed during a survey
for microphone installation was brought to Mr. Allen's
attention. The matter was resolved in favor of indicating
where appropriate, in the Bureau's response to the
Department, that FBIHQ and field office files contain no
indication an entry was effected for the survey. Where
evidence exists to the contrary, the survey would be
treated as an entry.
