extensive discussions were held between Bureau representatives
and officials of the Department concerning the use of nicro-
phones in the cases agninst communist leaders then being
prosecuted under the Smith Act. It was agreed that, whenever

@ serious consideration to the
criminal prosecution in any case, the Bureau
would, u dvise the Department in detail
concerning any telephone or microphone surveillance employed
by the Bureau or by other Federal agencies when the latter
was known. In addition it was acreed that the Bureau would
furnish such information without a formal request whenever
it was aware or had reason to believe that the Department was
seriously considering prosecution. (Exhibit 17)

Mr. cInerney whether there was any doubt in his mind that

gubjects and that at least some of the microphones were
installed by trespass. Ur. McInerney replied that the
