Upon recetpt of thie information, Constc)]
secured a John Doe search worrant for the car which Marshall
and the others were ustng and when the Marshall car came along
the Nashville highway, itt wos stopped and a search was nade.
Assistant Attorney General Caudle, tn a letter to the Bureau on
January 7, 1947, stated that tt further appeared that the
Morsholl automobile was stopped three times - once for the
purpose of searching tt, a second time to tnapect Marshall's
operator's Iftcense, and a third time to make the arrest; thet
after the arrest, Marshall's companions were told that they
might proceed to Nashville; that, tn supposedly proceeding to
Columbta with Morehall, the officers turned off the main high-
way tnto a dirt road leading elsewhere; and that they returned
to the motn highway only after noticing that Marshall's com~
pantone were following them.
In January, 1947, our Memphis Office cenducted an
tnvestigatton into this matter and learned that Constable Gi
had received tnfornation from a colored informant that Marsha .
and his compantons were leaving Columbia, Tennessee, on the
night of November 18, 19468, in an automobile tn which there
would be a quantity of whisky. On the basis of this tnforma-
tton swore out a John Doe warrant because he did not know
who owned the automobile. <Accompanted by a constable and two
deputy sheriffs, he stopped the automebile driven by Marshall
between 7 and & p.m. on the evening cf November 28th. No
whisky was found tn the automobile. Deputy Shert/ fs Gi ond
rrested Varshall after detecting that he had been drink-
tng on the basts of Marsholl'’s driving an automobile under
the tnfluence of liguor.
Marshell, according to the officers, was taken
Gtrectly to the office of Megtatrate Poague, who erpressed the
optnton that Marshall wos not drinking, whereupon Morsholl was
released. The officers contended that they stopped the auto-
mobtle only once and that the entire operation from the tine
of atopping the car until Marshall's release was within a
thi rty-mtnute pertod.
The Department, en Morch 11, 1947, requested that
- addtttonal investigation be conducted tn thts oase for the
Jfollowtng reasons. During the tntervtew with Conetable
he stated that tn the beginning he had obtatned the tnformotion
which eaused htm to secure the search warrant from a colored
