changed his story and said he felt he was being the "fall
guy" in the entire incident and that the original information
was gtven to him by Sheriff Fieming and some of his deputies,
who requested Butts to swear out. the warrant. Butts expressed
the belief that "Sheriff Flening wanted to get a ‘last crack!
at Weaver, Looby and Marshall. The Department requested that
Constable Butts be retntervieweds; that a stgned statement be
secured from him, if possible, and. that he be asked to disclose
fully the circumstances, evidence and conversations with Sheriff
Fleming and his deputies in connection with their request that
Butts swear out @ warrant on the basis of information which
they had received. ;
Butts executed a signed statement in which he stated
that he received information from Sheriff Fleming upon which he
based his affidavit for @ search warrant. A signed statement
Secured from Sheriff Fleming and Deputtes Gray and Lentz re-
flected that Butts informed them that he had information from
an informant upon whitch Butts secured the search warrant.
Magistrate Foague advised that the affidavit and search war-
rant were destroyed by him when nothing was found in the car
tn question and no record was kept.
on August 27, 1947, the Department advised that it
was not belteved that there was sufficient basis of prosecutive
action tn this case and, accordingly, no further investigation
need be made by. the Bureau.
Meron Long Case
On March 21, 1946, the Department referred to the
Bureau @ letter from Thurgood Marshall enclosing a copy af a
complaint made by one Meron Eong. Long stated that he was a
soldier in the regular Army and after serving tn the South~
west Pacifie, was given a 90-day furlough to vistt his parents.
He stated that he and his brother, Kenneth, and a cousin,
Causby Clay, went to a filling station in Fl Campo, Texas,
operated by one Joe Tudtke, to get some cold drinks. While
standing there a white man ordered the cousin to put his
‘shirt tail in. The cousin replied that he did not know his
shirt tail was out. ‘The man became infuriated and began —
‘cursing, and Long claimed that they walked away, As they
walked down the road, they met the sheriff. and he told them
to: return toa the filling stati on.
A fight ensued and Meron was slapped by the sheriff,
who pulled out his pistol. Shots were fired and Kenneth was
killed. The Department requested. that we make a preliminary
investigation into this matter and to furnish the U. S. Attorney
at Houston with copies of the report. The facts developed that
