Well certainly, as you know, had there been any hint
of this type of action or situation, not only would
Justice Fortas not have received our support, he
wouldn't have been nominated. I’m certain of that.
We, those of us, and I think a majority of the
Judiciary Committee, on the basis of the record
before us... on his record as a lawyer andasa
Justice, signed a report in which we felt that he
was qualified to be Chief Justice and, of course,
we didn't have this information.
You think it was withheld... that information?
Well, that’s one way of putting it. Certainly...
Is that the only way to put it?
Well, I don't know what you want to call it...

By anyone other than Justice Fortas? Is it in the
hands of the Justice Department?
