Offense Codes Applicable to FBI's Internal Disciplinary Process The listed offenses apply to all FBI personnel, regardless of position or title. The term on duty" refers to the period when an cmployce is performing an official duty or acting in an official capacity, whether or not the employee is being paid at the time (e.g., misconduct occurring while an employee is driving a Bureau vehicle home at the end of the emplovee's shift is considered "on duty" for administrative disciplinary purposes.) See the Penaltv Guidelines (Tab B) for an expanded discussion of applicable penalties, including examples of mitigating and aggravating factors for various offenses. 1.INVESTIGATIVEMISCONDUC Offense Code 1.1 Knowingly or recklessly failing to obtain proper authorization for a source's participation in otherwise illegal Assct/CW/Informant/CHS activity; or failing to timely inform the appropriate FBI official of a source's unauthorized criminaI activity about (Sourcc) - Failurc to Obtain which the employee knows, or reasonably should know, based upon all available information. Criminal activity Authorization or Rcport. includcs all violations of the law. Criminal Activity Mitigated: Letter of Censure - 5 Davs Penally: 7 Days Aggravated: 10 Days - Dismissal Offense Code 1.2 Without authorization, directly or indirectly loaning money to or receiving money from a source; giving a Assct/CW/Informant/CHS favor/gift to or accepting a favor/gift from a source; paying a source for a favor, gift, or service; or attempting to (Sourec) - Impropcr Financial. obtain any favor, gift, or service from a source. This includcs financial bcncfits, favors, and gifts confcrrcd upon an Rclationship cmploycc's relativcs or associatcs duc to the cmploycc's relationship with thc source. Mitigated: Letter of Censure - 5 Davs Penalty: 7 Days Aggravated: 10 Davs - Dismissal Offense Code 1.3 Without authorization, aiding, protecting, harboring, or shielding a source, or any attempt to aid, protect, Assct/CW/Informant/CHS harbor, or shield a source from law enforcement or legal obligations.
