Memorandum for Mr. Belmont
RE: UNSUBS; BOMBING OF SIXTEENTH
STREET BAPTIST CHURCH

through the facilities of our Laboratory and Identification Divisions. Therefore,
SAC Faisst should appear and assure the grand jury in line with above.
DEPARTMENTAL OPINION:
The above request of the USA was discussed with Mr. John L.
Murphy of the CRD of the Department on 2/5/64.
It was pointed out to Murphy that as he knew following the bombing,
we immediately entered the investigation, sent a special squad of Agents into
the area and conducted thousands of interviews both in Alabama and neighboring
states in an attempt to bring about a solution. It was pointed out to Murphy
that we had voluminous memoranda and reports on the bombing but that in view
of the fact we had no prosecutable evidence to prove a Federal crime, we were
not disseminating the information, Murphy agreed and indicated that he was
satisfied that the Bureau was conducting an extensive investigation and until
such time as there was something concrete to go on or someone to prosecute
the Department did not require reports. He indicated it would be proper to
appear before the grand jury and indicate we are continuing to investigate this
matter in line with the above recommendations.
ACTION TO BE TAKEN:
(1) Faisst will personally appear before grand jury and confine his
remarks to the facts as indicated above that we have conducted from the outset
an extensive investigation of this case and that we are continuing to exert all-
out effort to bring this matter to a logical conclusion; that we have cooperated
with the local authorities throughout the investigation and we are continuing to
cooperate; that we have conducted thousands of interviews; that we have conducted
extensive technical examinations of various types of material which may have
a bearing upon the ultimate solution of the case through the facilities of our
Laboratory and Identification Divisions.
